In 2021, I experienced one of the most violent and degrading events of my life inside MarinHealth Medical Center. What happened was not a \u201cmiscommunication,\u201d not a \u201cbehavioral incident,\u201d and not a \u201clow\u2011level concern.\u201d It was assault \u2014 carried out by hospital staff, in a hospital setting, against a patient who posed no physical threat.<\/span><\/p>\n

This is my record of what happened, and how every oversight body has tried to bury it.<\/span><\/p>\n

The Incident<\/span><\/strong><\/p>\n

I walked past a staff member who directed a verbal slur at me \u2014 clear, intentional, and meant to provoke. I responded with a single word and returned to my room to cool off.<\/span><\/p>\n

Moments later, 7\u201310 staff members rushed my door, shouting angrily, pounding, and escalating the situation into something terrifying. I held the door closed out of fear \u2014 because any reasonable person would. It was the only thing separating me from a wave of enraged toxic masculinity.<\/span><\/p>\n

They forced their way in.<\/span><\/p>\n

They grabbed me by the arms and legs \u2014 a method no legitimate medical training endorses \u2014 and compressed my spine like an accordion. They applied a chokehold that cut off my airflow for 15\u201320 seconds, long enough to make me nearly lose consciousness given my elevated HR. I couldn\u2019t eat without pain for two weeks afterward. My pre\u2011existing lumbar pain was worsened.<\/span><\/p>\n

This wasn\u2019t \u201cde\u2011escalation.\u201d<\/span><\/p>\n

This wasn\u2019t \u201cclinical restraint.\u201d<\/span><\/p>\n

This was rage, retaliation, and punishment.<\/span><\/p>\n

There is no medical justification for choking a patient. None.<\/span><\/p>\n

The Aftermath<\/span><\/strong><\/p>\n

I reported the incident. I documented it. I pursued every channel available.<\/span><\/p>\n

And here is what the California Department of Public Health told me:<\/span><\/p>\n

\u201cWe have determined that it does not rise to the level of an adverse event or high\u2011level incident.\u201d<\/span><\/p>\n

Choking a patient is \u201cnot serious.\u201d<\/span><\/em><\/p>\n

A mob of staff violently dragging someone is \u201cnot serious.\u201d<\/span><\/em><\/p>\n

A slur from an employee is \u201cnot serious.\u201d<\/span><\/em><\/p>\n

They referred me to The Joint Commission \u2014 the accrediting body responsible for oversight.<\/span><\/p>\n

The Joint Commission responded with a form letter explaining that because more than three years had passed, they would not review the case. They would simply \u201cmonitor trends.\u201d<\/span><\/p>\n

In other words:<\/span><\/p>\n

No one is responsible. No one is accountable. No one is even interested.<\/span><\/em><\/p>\n

The Reality<\/span><\/strong><\/p>\n

The thugs and medical fascists who assaulted me likely still work there. They likely still treat patients. They likely still believe they can act with impunity because oversight bodies have demonstrated exactly that: impunity is the norm… until someone like Luigi shows the fuck up.\u00a0<\/span><\/p>\n

They behaved the way they did because they assumed:<\/span><\/p>\n
